Not every couple needs a “prenup.” With over twenty-five years of experience handling a wide range of family law concerns, attorney Matthew M. Kremer will take a look at your situation and help you determine whether there is a form of agreement that would work for you.
Prenuptial Agreements
The decision to enter into a prenuptial agreement is a sensitive and complicated one, and the drafting of a prenuptial agreement is crucial to its enforceability once a divorce has been filed. As a contract between parties prior to marriage, it can determine who will receive what assets in the event of a divorce. However, a prenuptial agreement cannot determine the custody or support of the parties' future children. It can, in some cases, affect spousal support obligations.
When a prenup is negotiated, the parties do not have fiduciary duties to one another. And while it offers much flexibility, a prenuptial agreement cannot contravene public policy. It can, however, be very effective in protecting future property acquisitions.
Postnuptial Agreements
Postnuptial agreements are created between parties after their marriage, often after the parties have accumulated numerous assets and debts. Like a prenuptial agreement, it is a contract in which the parties agree to a division of the assets and debts. A postnuptial agreement can also be used to amend a prenuptial agreement or to protect the interests of children from prior marriages or relationships.
Attorney Kremer has experience in creating postnuptial agreements that determine ownership of complex issues such as community business interests, stocks, stock options and other employment incentive assets that couples may accumulate after their marriage.
